  1. Application

 

2.1. These Terms and Conditions apply to all agreements with all companies and individuals who contact LTC through the Website to participate in a workshop or training and any other activity of LTC (hereinafter "Participants"). By registering for a particular workshop, the Participant declares to fully and unconditionally agree to these Terms and Conditions.

 

2.2. LTC reserves the right to unilaterally amend these General Terms and Conditions. The current version of these General Terms and Conditions will always be available on the Website at https://livetheconnection.com/algemene-voorwaarden.

 

2.3. Every person accessing the Website declares to be of legal age and to have full legal capacity. If you do not meet these requirements, please leave the Website immediately.

 

  1. Right of Withdrawal

 

3.1. Insofar as the Participant is a natural person, the Participant may invoke the following right of withdrawal:

The Participant has the right to revoke the agreement without giving reasons until 14 days after registration. This means that the Participant can cancel his registration during the first 14 days after registration. The administrative cost for cancellation is €121. If the Participant cancels more than 30 days before the Workshop, Training or activity, the full registration amount minus the administrative fee will be refunded.

 

In addition, the following applies: if the Participant cancels within one month and two weeks before the start of the activity, 50% of the full registration amount will be refunded. If the Participant cancels within two weeks before the start of the activity, 25% of the full registration amount will be refunded. If the Participant cancels within 24 hours before the start of the activity, 0% of the full registration amount will be refunded. In addition, it is necessary to return the received workshop material in perfect condition to Puursesteenweg 10 Bornem within 2 weeks after the cancellation of the workshop. The refund will be made after this material is received in perfect condition. If the material is not in perfect condition, there will be no refund.

 

The withdrawal period expires on the day and hour of the start of the Workshop or activity.

 

In agreement with LTC, the Participant can reserve the registration amount for a Workshop or activity in the future. In this case, the full registration amount will be retained for a maximum of 1 year from the date of the agreement (the registration).

 

To exercise the right of withdrawal, you must inform us (see point 1 above) of your decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post, fax or e-mail). To comply with the withdrawal period, it is sufficient to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

 

3.2 If you withdraw from the contract, you will receive back from us all payments - except for the administrative fee of €121 - that you have made up to that point without delay and in any case no later than 14 days after we have been informed of your decision to withdraw from the contract. We will refund you within 14 days after you have provided us with the account number to which you wish to receive the refund. In any case, you will not be charged for the refund as such.

 

  1. Formation of agreement with the Participant

 

4.1. To reach the conclusion of the Agreement, the Participant must complete the following steps:

 

You place your order by checking the Workshop of your choice and the desired date, placing it in the shopping cart.
The selected Workshop will be displayed in your shopping cart. There you will see a summary of your registration for the chosen Workshop and the price due. On this page, you can also enter a discount code (coupon code), after which you must click on 'Apply Coupon' to reduce the price. You can delete or edit the entry in the summary. Then click on 'Proceed to checkout'.
You should enter your personal data and payment information. Any input errors can be detected and corrected here.
To confirm your registration, check the box "I expressly agree to the Terms and Conditions of Sale and Privacy Policy below," choose a payment method and press the "Place Order" link;
You must proceed to pay for your order through the online payment platform. By making the payment, the registration becomes final.
If you have fully completed this procedure, you will receive our confirmation and acceptance of your registration by email.
Once the registration has been accepted by LTC, your registration will be processed and we will contact you further if necessary.
There is a valid Agreement between you and LTC when, upon receipt of your payment, we confirm acceptance of your registration by email (step (vi)).

 

This contract can only be concluded in Dutch and English.

 

4.2. The person placing the order is considered the Participant and guarantees the payment of the registration.

 

4.3 The Workshop organizer and LTC have the right to refuse or cancel the order in case:

- of force majeure,

- the offer is no longer available

- the personal data provided by the Participant are incorrect

- there is reasonable doubt as to the accuracy or authenticity of the registration

 

If the organizer of the Workshop / LTC refuses or cancels the registration after the Participant had already made the payment of the registration price, LTC will transfer this price within 14 days after notification of the refusal or cancellation via e-mail, to the same bank account from which the payment was made by the Participant.

 

4.4. If it is proven that the Participant places false or fraudulent orders, LTC reserves the right to report this to the competent services.

 

4.5. Requests of the Participant to change the registration (e.g. to another Workshop or another location or date) will always be treated punctually and granted to the extent possible.

 

4.6. The Agreement is entered into until after the execution of the Workshop.

 

  1. Prices

 

5.1. Workshops are offered at the price determined on the Website for the relevant Workshop. All prices indicated are in Euro.

 

5.2. LTC reserves the right to change the prices on its Website at any time and to correct any input errors on its Website. The new prices will then apply immediately, but will not apply to subscriptions accepted prior to the price changes.

 

  1. Payment

 

6.1. The price due shall be paid at the time of registration. Payment is made by means of the online payment platform or, if otherwise agreed, for example in the case of pre-agreed staggered payment, by bank transfer to LTC's bank account IBAN BE03 0688 9224 0884, BIC GKCCBEBB.

 

If payment is made through the online payment platform, transaction fees may be charged in addition to the price due. By choosing to pay through the online payment platform, you give your express consent to the charging of these transaction fees.

 

6.2. The Participant authorizes LTC to contact the company that issued your credit or debit card to verify that the card is valid and valid payments can be made with it. The Participant also authorizes LTC to debit the credit/debit card for any amounts owed by you pursuant to your registration. You must ensure that the credit on your applied debit card is adequately provisioned to meet all obligations under these Terms and Conditions.

 

6.3. Payments through the online payment platform are certified by Mollie. With a single click, you will be redirected to Mollie's platform, where your financial data will be processed in complete security. The result is transmitted to us in real time. Your financial data remain invisible to us. LTC limits itself to recording the data necessary to process your order.

 

6.4. In case you owe a certain amount to LTC during the performance of the Contract, for whatever reason, you must make this payment within 3 days of posting your registration (insofar as the registration relates to a Workshop for later date), unless otherwise agreed (e.g., in case of pre-agreed payment in installments (instalments)).

 

An Agreement is not executed until LTC has received payment of the price due from the Participant prior to the date of the Workshop to which the registration applies.

 

6.5. If it is necessary for the Participant to pay the registration amount in installments (installments), the Participant will pay a first installment through the online payment platform on the website. The Participant will receive a provisional discount code (coupon code) to purchase the Workshop or activity through the website. The Participant transfers the remaining amount due via bank transfer within the pre-agreed deadlines.

 

6.6 Upon receipt of payment, LTC will remit an invoice to the Participant via email marked "paid. Any protest of an invoice from LTC must be made by reasoned email to LTC within 8 days of the invoice date.

 

  1. Commitments va LTC guarantees.

 

7.1. All of LTC's performance is resource commitments.

 

7.2. LTC undertakes to work with quality Workshop organizers. However, LTC offers no guarantees regarding the Workshop chosen. LTC bears no liability for the content of the Workshop organizer's advertisement as included on the Website nor for the proper execution of the Workshop by its organizer.

 

7.3. LTC is also not liable for any damage that the Participant may suffer as a result of his participation in the Workshop, or caused during the Workshop.

 

7.4. LTC is concerned only with the Mind-Body connection. The application of LTC has "curiosity around and regarding what you can accomplish with your mind" as its basic attitude. The Mind-Body connection is complementary and supportive.

 

With physical, psychological, psychiatric or other complaints of any kind, it is always necessary to consult a medically qualified physician. The information you obtain through LTC is not medical advice and can never replace it.

 

LTC is not responsible for the consequences of the ideas and connection processes applied by the Participant.

 

No one will be able to make a claim for damages, or seek redress in any way, from anyone on the basis of this information. Any self-healing is on your own responsibility.

 

In case of complaints or illness, the medical doctor, specialist or pharmacist is the appropriate person to provide assistance. The Participant is expected to follow their advice and prescriptions.

 

7.5. LTC is only liable to the Participant for the damage caused by gross negligence or fraud on the part of LTC or one of its appointees. The Participant must provide proof of this. LTC's liability is limited to the direct damage of the Participant (with the exception of indirect damage) which can never exceed the price of the Participant's registration for the Workshop during which the damage occurred.

 

  1. Intellectual rights

 

8.1. The concept, the Live The Connection method, the content of this Website, as well as the trademarks, logos, trade names, illustrations, page design, the data made available, the texts, images, as well as the software used in connection with the Website are protected by intellectual property rights belonging to LTC or third parties.

 

All works, such as (hand) books, slides, handouts, scripts and other materials (both in printed version and on electronic medium including video recordings) reflecting the content, conception, approach, design, etc. of the training are also protected by intellectual property rights belonging to LTC or third parties.

 

8.2. Any reproduction, distribution, sale or other exploitation of the Method and/or of this data by any means whatsoever is strictly prohibited without the prior written consent of LTC. This means that the Participant may not copy or otherwise distribute the workshop materials. The Participant may, however, work with the workshop materials for the benefit of himself and others in the context of family and friends service and professional assistance. The Participant may apply all the material learned in one-on-one relationships. In order to make the material available to groups, the Participant will first complete LTC's designated training program to become an Introducer and/or Teacher. Without a certificate of Introducer and/or Teacher - which guarantees quality - it is not allowed to distribute workshop materials other than 'The ABC of De-Stressing', which is publicly available.

 

8.3. The Participant agrees to refrain from any infringement of the intellectual property rights of LTC or the entitled third parties, to respect the trademark rights in the name 'Live The Connection' and not to use the sign 'Live The Connection' as a trademark, trade name, domain name or social media username. That means Participant shall not use 'Live The Connection' in their email address, domain name and/or trade name. Unless otherwise stated, storing information from the Website or related services in a database is prohibited, with the exception of storing on your hard drive these terms and conditions or your own orders. Specifically, this means that you may not further distribute the material made available to you as a Participant through the Website. You may, however, use it for incidental purposes.

 

8.4. The Participant agrees not to make any recordings of Live The Connection connection processes, Live The Connection workshops, Online Meetings or supervisions. Making recordings is prohibited not only because of Live The Connection's intellectual rights, but also because of GDPR, the regulations on privacy.
Live The Connection undertakes to make its own recordings that comply with GDPR regulations and these are made available to participants whenever possible, appropriate and within the interests of all concerned. Recordings cannot be passed on in any way, they remain the property of Live The Connection who decides on their dissemination.

 

  1. Use of video recordings

 

9.1 The Participant grants his permission to LTC to use photos and videos taken during a Workshop or event with his permission and the recording of his voice during the Workshop or an event for informational purposes to other Participants. All photographs and recordings (or parts thereof) used for promotional purposes on LTC's Website shall be submitted to the Participant prior to promotion. As such, the Participant hereby waives his right to image. If the Participant cannot agree to this publication, he must contact LTC, which undertakes to take this into account.

 

9.2 If the Participant expressly wishes his name to be mentioned, LTC is willing to mention his name within the feasible.

 

9.3 The Participant knows and agrees that no compensation will be paid for the use of his images and the transfer of his property rights and waiver of moral rights or portrait rights. If the Participant no longer wishes his recordings to be used, he must notify LTC by e-mail. LTC will then comply with this request to the extent possible and render the Participant unrecognizable.

 

  1. Unavailability of the Website

 

10.1. We reserve the right to modify the Website, or these terms and conditions, as for example, when the evolution of technology and security systems, or the evolution of applicable laws and regulations so require.

 

10.2. We also reserve the right to suspend service through this Website for maintenance or to make adjustments or improvements to the system. LTC cannot be held liable for this.

 

  1. Privacy Policy
    You can only place an order through this Website if you agree to provide accurate and complete information about yourself as requested during the ordering process. LTC respects and protects your privacy, as evidenced by LTC's Privacy Policy available at this link https://livetheconnection.com/privacyverklaring/ on the Website. We value the trust you place in our company and any personal information you give us will be treated with the utmost care and confidentiality.
  1. Varia
    If one or more provisions of these Terms and Conditions are void or unenforceable, the remaining provisions will retain their full effect.
  1. Applicable law and competent court
    The relations between the Participant and LTC are governed solely by Belgian law. Any disputes shall be submitted to the competent Courts of the judicial district of Antwerp, Antwerp Division.
